DC Circuit Moot -- Ali Hamza Ahmad al Bahlul v. USA

This is a mooting of a real case in which counsel for the Appellant will appear at oral argument in the DC Circuit later in the week. The case arises from a Guantanamo Military Commission in which the Appellant was convicted of, among other offenses, conspiracy to perpetrate the 9/11 Attacks.
Three issues are on appeal: (1) whether the authority that convened the Commission was properly appointed under the Appointments Clause, (2) whether a recent Supreme Court case changed the law on appellate waiver, thereby changing the standard of review for Appellant’s conspiracy conviction, and (3) whether the Appellant was properly resentenced on remand after his material support of terrorism and solicitation charges were dismissed.
